Terms of Service

1. Acceptance of Terms
By accessing or using VentoFlo ("the Service"), you agree to be bound by these Terms of Service. The Service is provided by VentoFlo ("we", "us", "our") for use by licensed Adult Family Home operators, their staff, and authorized family members.
2. Description of Service
VentoFlo provides a cloud-based platform for managing Adult Family Home, Adult Foster Home, Residential Assisted Living Facility, and Residential Care Home operations including medication administration records (eMAR), resident care documentation, staff compliance tracking, incident reporting, and regulatory reporting. The Service is designed to support compliance with applicable state regulations — including Washington (WAC 388-76), Oregon (OAR 411-050), Idaho (IDAPA 16.03.22), and Nebraska (172 NAC 4) — but does not guarantee regulatory compliance.
3. Account Responsibilities
- You are responsible for maintaining the confidentiality of account credentials
- You must ensure that only authorized personnel access the Service
- You are responsible for all activities that occur under your account
- You must promptly notify us of any unauthorized access or security breach
- The facility administrator is responsible for managing user roles and permissions
4. Data Ownership
You retain ownership of all data entered into the Service. We do not claim ownership of your facility data, resident records, or any content you create. You grant us a limited license to store, process, and transmit your data solely to provide the Service.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Share access credentials with unauthorized individuals
- Attempt to access data belonging to other facilities
- Reverse engineer, decompile, or disassemble the Service
- Use the Service to store data unrelated to residential care operations
6. Pricing and Payment
- Subscription fees are billed monthly or annually as selected
- Per-resident fees are based on active residents (discharged/deceased residents are not counted)
- Prices may change with 30 days' written notice
- Annual plans receive a 10% discount and are non-refundable
- Monthly plans may be cancelled at any time; service continues through the paid period
7. Service Availability
We strive for high availability but do not guarantee uninterrupted service. The Service includes offline capabilities that allow continued operation during internet outages. We will provide reasonable notice of scheduled maintenance. We are not liable for downtime caused by factors outside our control.
8. Regulatory Compliance Disclaimer
VentoFlo provides tools designed to support compliance with the regulatory requirements that apply to residential care in your state — including the Washington Administrative Code (WAC 388-76), Oregon Administrative Rules (OAR 411-050/051), Idaho Administrative Procedures Act (IDAPA 16.03.22), and Nebraska Administrative Code (172 NAC 4). However, regulatory compliance is entirely dependent on how you use VentoFlo — including the accuracy and completeness of the data you enter, the timeliness of your documentation, and your adherence to regulatory requirements in your day-to-day operations.
We do not and cannot guarantee regulatory compliance because we have no control over what data is supplied to the system, how the system is used, or whether operational practices outside the system meet regulatory standards. The facility and its licensed operator bear sole responsibility for ensuring compliance with all applicable state regulations, licensing-agency rules (DSHS, ODHS/APD, IDHW, DHHS), and federal laws.
VentoFlo should be used as a compliance aid — not a substitute for understanding and following regulatory requirements.
9. Limitation of Liability
The Service is a tool to assist with Adult Family Home management. It does not replace professional medical judgment, nursing assessments, or regulatory expertise. We are not liable for clinical decisions made using information in the system. The facility remains responsible for all care delivered to residents and for regulatory compliance.
10. Termination
Either party may terminate this agreement at any time. Upon termination, you may request a data export within 30 days. After 90 days, your data will be securely deleted unless retention is required by law or regulation.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.
